Eight US States Sue OpenAI Over Alleged ChatGPT Safety Risks

A bipartisan group of eight US states has sued OpenAI in separate court cases, alleging that its ChatGPT chatbot has contributed to harmful behaviour among users, including teenagers.

The lawsuits, filed independently in state courts, claim that ChatGPT is designed to be agreeable and engaging in ways that can build users’ trust while reinforcing delusions, encouraging dangerous behaviour and helping users plan violence.

The states involved include Iowa, Kansas, Arizona, Arkansas, Idaho, Montana, Nebraska and West Virginia.

States Challenge ChatGPT’s Safety Measures

The attorneys general allege that ChatGPT’s conversational design can create risks for vulnerable users. The lawsuits claim that the chatbot has, in some cases, encouraged self-harm or harm to others and assisted users in planning attacks, including mass shootings.

The states accuse OpenAI of violating consumer protection laws by misleading users about the safety of its technology. They also allege that the company has created a public nuisance by putting residents’ health and safety at risk.

The claims have not been established in court.

Lawsuits Seek Changes to OpenAI’s Technology

The states are seeking court orders requiring OpenAI to change how ChatGPT operates, alongside civil penalties and damages for alleged violations of state law.

Among their demands, the states want OpenAI barred from developing AI models capable of improving themselves unless the company can ensure that those systems remain aligned with human values.

The requested measures could have implications for how AI companies design, test and deploy conversational systems, particularly when those products are used by young people or other vulnerable groups.

OpenAI did not immediately respond to a request for comment, according to the report.

Growing Legal Pressure on OpenAI

The coordinated cases mark a significant expansion of legal scrutiny of AI safety at the state level. They add to existing litigation as OpenAI continues to face questions about the risks posed by its products.

Florida’s attorney general filed the first similar state lawsuit in June, according to the report.

OpenAI is also facing dozens of lawsuits brought by private plaintiffs. Those cases allege that ChatGPT helped users plan mass shootings or other acts of violence.

The growing number of legal challenges highlights disputes over the responsibilities of AI developers, the effectiveness of safeguards and the extent to which companies may be held liable for harmful outputs generated by their systems.

The eight state cases remain allegations at this stage. Their outcomes could help shape future legal standards for AI safety and consumer protection in the United States.
